The Legal Challenge

One of those who participated in the public testimony at the Joint Assembly Hearing – Budget SubCommittee #4 on State Administration and Revenue & Taxation Committee on Monday was attorney Donald Griswold from the firm Reed Smith. Mr. Griswold’s contribution was to present the results of a legal analysis which has concluded that the Governor’s proposal to retroactively eliminate earned carry-forward tax credits would be a violation of taxpayers’ Constitutional due process rights. Furthermore, they think that cancelling the zones in the middle of their 15 year designation periods is a violation of the Constitution’s Contracts Clause.
